These Terms of Service (“Terms”) are a binding agreement between you and Ocean Surveillance Services (“we,” “us,” “our”) and govern your access to and use of the OSS Console software, websites, demos, license keys, and related services (collectively, the “Software”). By installing, activating, purchasing, or using the Software, you agree to these Terms. If you do not agree, do not use the Software.
1License
- We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use one (1) license key for the unit you purchased — per vessel (Fishing) or per team, annually (Search & Rescue) — for your own lawful use.
- The Civil Air Patrol edition is provisioned separately and is not offered for sale here.
- We retain all right, title, and interest in the Software. You receive a license, not ownership. All rights not expressly granted are reserved.
2Restrictions
- You may not resell, rent, sublicense, share, publish, or redistribute the Software or any license key.
- You may not reverse engineer, decompile, or disassemble the Software except to the extent that applicable law expressly permits.
- One key is valid for the single unit purchased; sharing or distributing a key voids the license and may result in revocation without refund.
3Lawful & Safe Operation (Aviation / Drone / Maritime)
- You are solely responsible for the safe and lawful operation of any drone, aircraft, or vessel, including full compliance with FAA Part 107, airspace restrictions, LAANC/authorizations, remote-ID, and all local, state, national, and international laws, including privacy laws.
- The Software does not control or fly your aircraft and is not an air-traffic, flight-control, or collision-avoidance system. You remain the responsible operator at all times.
4Not for Navigation · Not a Safety-of-Life System
The Software — including maps, imagery, coordinates (latitude/longitude, MGRS, GARS), drift and datum estimates, search patterns, AI detections, bearings, fixes, and steering guidance — is provided for informational and planning purposes only.
- It is not certified for navigation and is not a substitute for official charts, certified instruments, established IAMSAR/agency procedures, trained human judgment, or the authority of competent agencies (e.g., U.S. Coast Guard, AFRCC, incident command).
- Do not rely on the Software as a sole or primary means for navigation, search and rescue, life-safety, or emergency decision-making. Always verify against authoritative sources and follow your training and agency protocols.
5AI Detection Disclaimer
AI and computer-vision detection is probabilistic and may produce false positives, false negatives, and other inaccuracies. Target/species labels and confidence values are estimates, not guarantees. You are responsible for independently verifying any detection before acting on it.
6No Warranty
THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AVAILABILITY, OR NON-INFRINGEMENT. We do not warrant that the Software will be error-free, uninterrupted, or that any result, coordinate, or detection is accurate.
7Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF LIFE, PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, OR LOST DATA, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some may not apply to you.
8Assumption of Risk & Indemnification
You acknowledge that drone, aviation, maritime, and field operations are inherently dangerous and that you assume all associated risks. You agree to indemnify, defend, and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your operations, your use of the Software, or your violation of these Terms or any law.
9Payments, Keys & Refunds
- Purchases are processed by third-party payment providers (e.g., Lemon Squeezy, Gumroad). Prices are in USD and may change. Applicable taxes may be added.
- Refunds: because the Software is a digital good and the license key is delivered immediately, all sales are final once a key has been issued, except where a refund is required by law. If you have any problem activating, contact us and we will make it right.
- License keys are confidential. We may revoke any key used in violation of these Terms.
10Third-Party Services & Branding
- The Software may integrate third-party services (map imagery, web fonts, Google Sheets, streaming gateways, embedded video). Their terms apply; we do not control and are not responsible for them.
- Product names and logos (including DJI, and any agency or organization marks) are the property of their owners. We are not affiliated with, endorsed by, or sponsored by DJI, Civil Air Patrol, the U.S. Air Force, the U.S. Coast Guard, or any agency unless expressly stated in writing.
- If you upload or apply any organization’s logo or branding, you represent that you have the right to do so and you indemnify us for its use.
11Your Data & Privacy
The Software stores your operational data (contacts, missions, training images, settings) locally on your device. Optional features (e.g., Google Sheets logging, a cloud data hub) transmit data only where you direct. We do not collect your operational data through the app. Payment and email are handled by our payment provider (Gumroad) under their privacy terms.
12Updates & Availability
We may modify, update, or discontinue the Software or any feature at any time. Updates are provided under these Terms. We are not obligated to maintain backward compatibility.
13Termination
We may suspend or terminate your license immediately if you breach these Terms. Upon termination you must stop using the Software. Sections that by their nature should survive (including 4–8, 10) survive termination.
14Changes to These Terms
We may revise these Terms from time to time. Material changes take effect when posted. Your continued use after changes constitutes acceptance.
15Governing Law
These Terms are governed by the laws of the State of [Your State], United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in [Your State] for any dispute not subject to arbitration.
